1. The app
Our Baby Day (“the app”) is an iPhone app for recording a baby’s feeds, sleep, diapers, pumping, solids, tummy time, growth, milestones and health notes, optionally shared with other caregivers. It is provided by Daniel Chew (“we”, “us”). Our Privacy Policy explains how we handle your data and forms part of these terms.
2. Who can use it
You must be at least 18 years old, or the age of majority where you live, to create an account. The app is intended for parents and caregivers; it is not directed at children.
3. Your account and your family
You can use the app without an account, in which case your data stays on your phone and in your own iCloud. To share with other caregivers you sign in with Apple or by email code. You are responsible for keeping your device and sign-in method secure and for what happens under your account.
When you invite someone to your family, they can see and, if you give them the role, add and edit the records you share. Invite only people you trust with your baby’s information. The owner of a family can remove members; removal stops sharing from that moment but does not recall data a removed member’s phone already holds.
4. Not medical advice
The app records what you tell it and shows patterns, averages and reference ranges such as WHO growth percentiles. Ask, the in-app assistant, answers questions from those records using an AI model. None of this is medical advice, diagnosis or treatment, and none of it replaces your paediatrician, midwife, nurse or doctor. AI answers can be wrong. Always check anything that matters against your own records and a qualified professional, and in an emergency contact emergency services.
5. Subscriptions and purchases
The core of the app is free. Premium features are unlocked by a monthly or yearly subscription, or a one-time lifetime purchase, all sold through Apple’s App Store. Prices are shown in the app before you buy.
- Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Your Apple Account is charged on renewal.
- Where a free trial is offered, the subscription starts and you are charged when the trial ends unless you cancel before then.
- You manage and cancel subscriptions in your device’s Settings under your Apple Account. Deleting the app does not cancel a subscription.
- Refunds are handled by Apple under App Store terms; we cannot issue them directly.
- Premium applies to your whole family: when the purchaser has it, every member does.
6. Acceptable use
You agree not to:
- use the app for anything unlawful or to harm anyone;
- try to access other families’ data, probe or overload our servers, or bypass the app’s limits;
- reverse-engineer, copy or resell the app except where the law allows it;
- upload content you do not have the right to share, or content that is abusive or illegal.
7. Your content
Everything you enter, including photos, stays yours. You give us only the licence needed to store it, sync it between your family’s devices, and process it to provide the features you use, as described in the Privacy Policy. We do not use your content for advertising or to train AI models.
8. Our content
The app, its design, mascots, text and code are ours or our licensors’ and are protected by copyright and other laws. We grant you a personal, non-transferable licence to use the app on Apple devices you own or control, as permitted by the App Store terms.
9. Availability and changes
We work to keep the app and sync running, but do not promise they will be uninterrupted or error-free. We may change, add or remove features, and may discontinue the service with reasonable notice. Keep your own backups of anything you cannot afford to lose; local mode keeps a copy on your phone and in iCloud.
10. Ending things
You can stop using the app at any time and delete your account from Settings. We may suspend or close accounts that break these terms or put other users at risk. Sections 4, 7, 8, 11 and 12 survive termination.
11. Disclaimers and liability
The app is provided “as is”. To the fullest extent the law allows, we disclaim all warranties, express or implied, and we are not liable for indirect, incidental or consequential loss, or for any loss arising from reliance on the app’s records, charts or AI answers. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, and nothing removes rights you have as a consumer under the laws of your country.
12. Governing law
These terms are governed by the laws of the United States, and disputes are subject to the jurisdiction of its courts, without prejudice to any mandatory consumer protection you enjoy where you live.
13. Apple
These terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app, is not responsible for any claims relating to it, and is a third-party beneficiary of these terms with the right to enforce them against you. Where these terms are less restrictive than Apple’s Licensed Application End User License Agreement, Apple’s terms apply as a minimum.
14. Changes to these terms
We may update these terms. The date at the top shows the current version. If a change is significant we will tell you in the app, and continuing to use the app afterwards means you accept it.
